Consumer Terms & Conditions

1. Introduction / Who We Are

These Terms & Conditions ("Terms") set out the agreement between you ("you", "your") and Neurosecure B.V., a private limited company registered in the Netherlands, with its registered office in Amsterdam ("we", "us", "our"), regarding your use of our consumer AI services, including our applications, websites, and software (the "Services").

2. Acceptance of Terms

By accessing or using our Services, or by creating an account, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

3. Account Creation & Access

• You must be at least 18 years old to use the Services.
• You must provide accurate and complete information when creating your account.
• You are responsible for maintaining the confidentiality of your login credentials and all activity on your account.
• You may close your account at any time by contacting us at info@velonova.ai.

4. Use of the Services

You may only use the Services for lawful personal and non-commercial purposes. You may not:

• use the Services to violate any applicable law,
• infringe third-party rights,
• attempt to reverse engineer, scrape, or misuse the Services, or
• interfere with security or integrity of the Services.

You must comply with any Acceptable Use Policy or guidelines we publish.

5. Inputs, Outputs & Intellectual Property

• You remain responsible for all content you submit to the Services ("Inputs").
• Our AI models may generate responses or materials ("Outputs") based on your Inputs.
• You retain ownership of your Inputs.
• Subject to these Terms, we grant you a personal, non-exclusive licence to use Outputs.
• We may use your Inputs to provide, maintain, and improve the Services.

6. Subscriptions, Fees & Payments

If you purchase a subscription or paid feature:

• You agree to pay the applicable fees and taxes.
• Fees will be charged in accordance with your selected billing cycle.
• Unless otherwise stated, subscriptions automatically renew unless cancelled.
• You may cancel at any time; your cancellation will take effect at the end of the billing period.
• As a consumer in the EU, you may have a 14-day statutory withdrawal right, unless you consent to immediate performance of digital services.

7. Third-Party Content & Links

The Services may link to or display third-party content. We are not responsible for such content or services, which are governed by their own terms.

8. Disclaimers & Limitations of Liability

• The Services are provided "as is" and "as available." While we strive for reliability, we do not guarantee accuracy or uninterrupted access.
• AI-generated Outputs may be incomplete, inaccurate, or inappropriate; you should verify important information independently.
• Nothing in these Terms limits or excludes liability where prohibited by law, including liability for death or personal injury caused by negligence.
• Subject to applicable law, our liability is limited to the amount you paid for the Services in the 12 months prior to the event giving rise to the claim.

9. Termination

We may suspend or terminate your access if you breach these Terms, misuse the Services, or where required by law. You may terminate your account at any time by contacting info@velonova.ai.

10. Changes to Services or Terms

We may modify these Terms or the Services. If we make material changes, we will notify you in advance (e.g. 30 days). If you do not agree, you may stop using the Services.

11. Data Protection & Privacy

We process your personal data in accordance with our Privacy Policy, which complies with the General Data Protection Regulation (GDPR). For details, please review our Privacy Policy.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Netherlands. Consumers in the EU may also benefit from mandatory consumer protection provisions of their country of residence. Disputes may be submitted to the competent courts in Amsterdam, unless mandatory consumer law grants you the right to sue in your local courts.

You may also submit disputes for online resolution via the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.

13. Miscellaneous

• If a provision of these Terms is found invalid, the rest remains in force.
• Our failure to enforce a right does not waive it.
• You may not transfer your rights or obligations under these Terms without our consent. We may assign these Terms.
• Nothing in these Terms affects your statutory rights as a consumer.
